  1. Acknowledgment and acceptance of Terms of Use

These Terms of Use govern your use of the UNSW Sydney Intellectual Disability Mental Health Connect website (“IDMH Connect”) including access to  IDMH Connect via your computer or mobile phone at the website located at https://www.idmhconnect.health (“Site”), which is owned and operated by The University of New South Wales (ABN 57 195 873 179) (“UNSW”). Access to and use of IDMH Connect is subject to your acceptance of these Terms of Use.

By accessing IDMH Connect you accept and consent to, without limitation or qualification, all of these Terms of Use, the IDMH Connect Privacy Policy (“Privacy Policy”), and the UNSW Privacy Policy. Before using IDMH Connect, please review these Terms of Use and our Privacy Policies carefully.

UNSW reserves the right to amend these Terms of Use or IDMH Connect without notice to you at  any time, however, we will post the amended Terms of Use onto the Site.

You will be deemed to have accepted and agreed to the revised Terms of Use if you continue to use any section of the Site after notice of the revised Terms of Use has been placed on the Site.

 

  1. About IDMH Connect

IDMH Connect is an information website designed to provide information around i) when, where and how people with intellectual disability can look for support for their mental health and navigate the mental health system and ii) how professionals can promote collaborative approaches to service delivery that meet the needs of people with intellectual disability across a mental health pathway. Use of IDMH Connect is completely voluntary. Users interact with IDMH Connect via the Internet on their mobile devices, tablets and/or their computers.

 

  1. Who is IDMH Connect for?

IDMH Connect is designed for i) people with intellectual disability, ii) their carers, family members, friends, support workers and advocates, and iii) mental health, health, disability, and social service professionals.

IDMH Connect is designed to be a collation of information and resources about where people may start to look for support for their mental health. This information is to the best of our knowledge accurate at the time of publication. While we make reasonable efforts to update information, we make no representations or guarantees as to its completeness, accuracy, or that it is up to date. It is not intended to be advice on which you should rely. IDMH Connect is not a substitute for clinical/medical treatment or advice.

If you are concerned that you or a person you support has a serious mental health condition such that you/they are at risk of harming themselves or another person, you should not rely on the information on IDMH Connect but should seek urgent medical advice from either a treating medical practitioner, mental health care professional, an emergency department of a hospital or, if in immediate danger, call the emergency number “000” (within Australia).

IDMH Connect has been designed with an Australian audience in mind and complies with Australian laws, regulations, codes and guidelines. Please note the laws of other countries may differ from Australia and you should seek advice or guidance from professionals or practitioners with knowledge specific to the place where you are located.

 

  1. Site registration

No site registration is required to access this Site.

 

  1. Evaluation

Site users have the option of participating in an evaluation of IDMH Connect (UNSW Sydney HREC Ethics approval HC220792). If you wish to take part in a voluntary evaluation interview you have the option of providing us with your name, email address and/or phone number. We will handle all personal information we collect in accordance with our Privacy Policy.

 

  1. User risks and benefits

IDMH Connect offers i) information and resources that may help users navigate the mental health system and ii) provides professionals with an introductory overview of the needs of people with intellectual disability and how they can further develop their knowledge and skills in this area through the provision of information and links to external resources.

IDMH Connect does not “treat” anyone, or replace treatment provided by a health and/or mental health  professional. IDMH Connect does not provide i) personalised clinical advice, ii) crisis care, iii) access to face-to-face care at UNSW, or iv) localised service listings.

Therefore, risks associated with its use, include:

  1. the possibility of a person’s symptoms persisting while using IDMH Connect
  2. the possibility of a person’s symptoms worsening while using IDMH Connect
  3. the possibility of developing symptoms or conditions while using IDMH Connect
  4. the possibility that IDMH Connect is not suitable for a person at a particular point in time
  5. the possibility that the person is unable to access support for their mental health in their local area

In the event of any of these risks occurring, you or the person you support should seek help from a treating medical practitioner, mental health care professional, an emergency department of a hospital or, if in immediate danger, call the emergency number “000” (within Australia).

 

  1. Availability of Site

UNSW will use its best efforts to ensure availability of IDMH Connect, but this cannot be guaranteed outside normal business hours (9am–5pm, Monday to Friday). UNSW makes no representations as to server reliability, speed, or consistency, and cannot be held liable for such.

We do not guarantee that our Site, or any content on it, will always be available, uninterrupted or be error-free. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal. You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

 

  1. Fees and charges and cancellation

There is no fee or charge for you to use IDMH Connect. However, if you access IDMH Connect through the use of the Internet, your Internet charges will apply.

UNSW reserves the right to change the usage fees associated with IDMH Connect at any time. UNSW will place a notification on the Site if there are any changes to usage fees. If this occurs, you will be free  to choose whether or not to continue to use IDMH Connect.

 

  1. Continuation of IDMH Connect and the Site

We reserve the right to discontinue IDMH Connect and the Site at any time and for any reason.

 

  1. Disclaimer and limitation of liability

This site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, including the Australian Consumer Law UNSW makes no representations or warranties of any kind, express or implied, as to the Site’s operation or the information, content or materials included on IDMH Connect.

To the extent permitted by law, all representations, conditions or warranties, whether based in statute, common law or otherwise, are excluded. To the full extent permissible by applicable law, the administrators of IDMH Connect and UNSW hereby disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for any particular purpose. Neither IDMH Connect nor UNSW will be liable for any damages of any kind arising from the use of or inability to use this site. You expressly agree that you use IDMH Connect solely at your own risk.

The materials displayed on IDMH Connect (“Content”), including without limitation all information, text, materials, graphics, names, logos and trademarks are for information purposes only. Content may not be right for you or the person you support. Content should not be  relied on as a substitute for professional advice on your or any other person’s health or the assessment, treatment or prevention of any disease. Persons accessing IDMH Connect do so at their own risk. You should always seek the advice of a physician or other qualified health provider with any questions you have regarding a medical condition. You should never disregard professional medical advice or delay in seeking it as a result of anything you read on IDMH Connect.

To the maximum extent permitted by law, including the Australian Consumer Law, UNSW has no responsibility or liability in relation to any direct or indirect loss or damage that you incur, including but not limited to damage to your software or hardware or mobile phone or injury to you or anyone else arising from your use of or access to IDMH Connect, or as a result of the inaccessibility of the Site and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date. UNSW makes no warranty regarding the quality, accuracy, merchantability or fitness for purpose of the Content of IDMH Connect.

 

  1. We are not responsible for viruses

UNSW does not warrant that IDMH Connect or functions contained in IDMH Connect, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected, or that our server or the server that makes it available is free of viruses or bugs or any other type of malicious code or software.

You are responsible for configuring your technology to access our Site. You should use your own anti-virus software.

 

  1. Access to, use and ownership of IDMH Connect content

The Content in IDMH Connect is owned or controlled by UNSW and protected by copyright, trade mark laws and other intellectual property. You obtain no interest in the IDMH Connect Content.

The Content, material, logos and illustrations provided in IDMH Connect are the property of UNSW. You may download, store in cache, display, print and copy a single copy or part of a single copy of information or material from this Site only for your non-commercial personal use, or use of someone you support (in a paid or unpaid capacity) and only in an unaltered form. The Content may not be reproduced or redistributed or otherwise used for any other purpose without permission. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit, distribute, perform, license, commercially exploit, create derivative works from, transfer, see or communicate to the public the Content (or a substantial part of it) in any way except as expressly provided for in these Terms of Use or under the Copyright Act 1968 (Cth) or other applicable laws.

You are granted the right to view IDMH Connect Content using your web browser and mobile phone for your own personal, non-commercial use only on the terms and conditions set out in these Terms of Use and, where applicable, as expressly authorised by us and/or our third-party licensors.

You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising  or advertising revenue generation activity on your own website.

 

  1. Quality of information

Any errors in the Content that are brought to our attention will be corrected as soon as possible. UNSW reserves the right to change any Content on IDMH Connect at any time without notice. While we make reasonable efforts to update information, we make no representations, guarantees nor provide any warranty as to the completeness, accuracy, or currency of information on our Site.

 

  1. We are not responsible for external links on our Site

Links to external websites on IDMH Connect are provided on an information source basis only. UNSW makes no warranty and accepts no responsibility or liability in relation to any information, products, services or advice provided by these external links, and any views or recommendations provided in linked sites do not necessarily represent those of UNSW. You acknowledge that  you enter any third-party websites at your own risk.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. The website in which you are linking must comply in all respects with the content standards set out in clause 12.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Our Site must not be framed or mirrored on any other Site, nor may you create a link to any part of our Site other than the home page.

These Terms of Use are governed by and are to be interpreted in accordance with the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales.
